If approved, the filing fee for administrative cases against Barangay officials will be at P 2, 500 per case by the party who intends to file the complaint.

However, the proposed measure provides that no filing fees shall be assessed on any indigent complainant who files with the Sangguniang Panlungsod.

The indigent complainant must secure a certificate of indigency from the City Social Welfare and Development Office.

Finally, the complainant may be declared indigent only upon approval of the SP.

The proponent, Councilor Karissa Faye Tolentino-Maxino explains that this measure seeks to discourage the practice of indiscriminate filing of administrative cases against barangay officials.

It is noted that if not regulated, frivolous administrative cases unnecessarily drain the time, resources and efforts of the Sangguniang Panlungsod members which could have been utilized in more important legislatives functions.

There are even cases that cases may probably be designed to harass barangay officials who are simply doing their jobs.

In the recent public hearing for the measure, Poblacion 8 Punong Barangay Maelyn Rose Mariano suggested to raise the filing fee up to P 10, 000 as a form a deterrent while Bajumpandan Kagawad Juancho Gallarde suggested that the imposition of filing fee shall be per case and per barangay official.

Councilor Tolentino-Maxino said that all the suggestions will be taken into consideration prior to the final deliberations of the proposed ordinance.
